TupperS Law client settles hybrid damages claim before the CAT

Long-standing TupperS Law client Utilita Energy settled a “hybrid” damages claim before the Competition Appeal Tribunal in May 2025, just a few short weeks before trial. 

“Hybrid”, so called, because it arose out of an Ofgem investigation of PayPoint PLC which itself was settled with commitments back in 2019 which meant that even though it was not strictly speaking a follow-on damages claim in the absence of a final adverse regulatory decision, Ofgem had already trodden the same path in terms of establishing liability.  Once again, TupperS Law has shown that we have the capacity to handle significant first-principles claim work and contest these matters in the senior forum against bigger and better resourced legal teams.  While big may be beautiful to some, good things definitely come in small, focused packages.
